No sugarcoating this: the jury reached a not guilty verdict in the Sussman trial, on the single count of lying to the FBI.
That is a loss, by any measure.
Not how one would want to start off a string of other indictments in what they themselves called a conspiracy.
But that being said, reality is hardly ever black-and-white.
Yes, Team Clinton scored a win today.
But also: yes, this was a Pyrrhic victory, one they paid at very high cost.
And of course, they will want to turn this into a clear victory, and demoralize and divide the side of their opponents even further. So don’t allow yourselves to be ‘black-pilled’. Don’t dismiss any attempt to take proper measure of this trial and take stock of the negatives, as well as point at positives, as mere ‘copium’. Don’t wallow is despair.
As on cue, the doomsayers are out in force, telling us ‘I told you so! No one will get convicted, no one will be punished. There will be no justice! So just accept the inevitable, and move on!’
Of course, they really want us to move on, and drop this, completely!
But they can’t. Because Durham indicted Sussman, and in the process of the proceedings, lifted the lid on what has been going on. What many of us had suspected, without any proof, was confirmed in official court filings and sworn testimony.
Technofog gave a great overview of the different points we learned out of this trial:
1) Data from the Executive Office of the President of the United States, including data from the Trumansition period, was exploited by Sussmann and Rodney Joffe and then passed to the CIA.
2) Rodney Joffe was a longtime Confidential Human Source (CHS) – and generally a resource – for the FBI. Joffe worked with the FBI on cyber threats from countries like Russia. From former FBI Agent Grasso: “I’m sure the work that [Joffe] did touched on matters having to do with Russia.”
3) Joffe went to great lengths to make sure the Alfa Bank information he provided to the FBI did not go through his official FBI handler.
4) The decision to open the investigation came from FBI Leadership. According to one FBI Agent, “People on the 7th floor to include Director are fired up about this server.”
5) Perkins Coie partner Marc Elias provided updates on the Fusion GPS “research” to the Clinton Campaign.
6) And - Hillary Clinton herself approved of the strategy to disseminate the Alfa Bank allegations to the media.
This is HUGE.
Brian Cates, who has followed the Durham investigation for years now, has repeatedly pointed out that Durham was VERY elaborate in his court filings and indictments, well beyond what is necessary. Why was that?
I think because this provided a legal way to introduce trustworthy evidence and narratives to the public.
Why would he start out with this one indictment, of a low level guy, for ‘lying to the FBI’ as a separate case? (Obviously, this is me using retrospect)
Why not fold the different claims into a single court case, slamming Sussman with everything Durham got on the guy? Including, notably, a charge for the conspiracy that has come up during the trial?
And don’t forget that until the Sussman indictment, people didn’t even believe that Durham was real!
Durham has been laying out his case in extreme detail.
Proven, beyond any doubt, that Sussman lied, as well. But was that the main goal of his indictment? Convict Sussman of lying?
Or was the goal to destroy the attorney/client privilege defense?
Get other sworn statements and testimonies which he can use for further trials?
Expose the rot in the system, and the very partisan nature of this case, and how that affects jury trials?
I am no expert in American Law and judicial proceedings, not even in the slightest. But this looks like grounds to ask for a change of venue for any further trial. If that can be achieved, letting Sussman off the hook for this minor charge of lying to the FBI will be a small price to pay.

And Just Human thinks along the same lines:
I’ve said for the past week or so that I think Durham’s number one objective was piercing attorney-client privilege, second was getting the evidence and testimony on the record, third was convicting Sussmann.
Bummer he didn’t get the guilty verdict, but it’s CRITICAL that he got the first two objectives.
On the surface, the naysayers are right: It is IMPOSSIBLE to get a guilty verdict in this case in DC courts, with DC juries.
That is what we see.
But at the same time, Durham did not seem to care much about his jury here. Why was that?
To me, it points at Durham chasing something else entirely in this specific trial, than actual conviction. Give the enemy the acquittal, and have them think they won, while you gained the knowledge and high ground for the next attacks.
And Sussman is hardly the main target in this whole case, either! Nor is this lie to the FBI the key point in the conspiracy. I find it hard to believe that Durham would spend all that time, with such incredibly disciplined and 100% leak-proof team, to bring a first case as narrow as this, about as minor an infraction as a single lie, by a minor player, with such little attention paid to the jurors, if this was their main catch, their main goal.
Time will tell, even if many among us are getting really tired, and really impatient.
Meanwhile, Durham continues, and we continue to learn more and more about this case, from official documents. This has only begun.
And to those who think this is ‘copium’?
Get a life. Get some actual hope. Stop pulling everything down in negativity. Find the positives, and keep moving forward. Identify the negatives, and plan to counter them. Don’t give up after the first minor skirmish. Don’t lose track of the bigger picture, and the incredible strides forward that are being made, or the many people who are waking up to this reality. Roll with the punches, and stay in the fight.
The best is yet to come.
